Enrolment language courses – Start and durations – Payment terms
The conclusion of a contract between Sprachschule Aktiv Mannheim and the customer occurs through the enrolment and the course or exam confirmation provided by the school administration. The enrolment can be completed either in a written way at school or by using the online form on the website.
The course fee is due latest 14 days after issuing the invoice or upon start of course in case the starting date is earlier than 14 days after issuing the invoice.
The course can either be paid in cash or via bank transfer. The customer obligates himself to pay in time. In case the course is visited partly or not at all the legal obligation to pay the course fee is not affected.
Bookings can only be made in time or teaching units (lessons), not in levels. Sprachschule Aktiv Mannheim does not and cannot guarantee reaching a certain level after a certain time.
General Terms
The durantion of one lesson (teaching unit) is 45 minutes. The customer does not have the right or a claim to choose the teacher. Sprachschule Aktiv Mannheim reserves the right to change or replace teachers, also during a course. By doing so the customer has no claims or rights. Especially a cancellation, a refund or a partly refund is explicitly debarred.
Sprachschule Aktiv Mannheim does not assume any liability for any customer to reach a certain level after a certain time. Analog Sprachschule Aktiv Mannheim does not assume any liability for any customer to pass an exam. A refund of the course or examination fees is explicitly excluded.
The customer agrees, that, in case of a default of payment, his personal data will be forwarded to the encashment, which will be assigned with the collection of the course fee.
There are no classes on public holidays. These classes will not be made up for and there is no claim for a refund or partly refund for these days.
In case the actual level of a student greatly deviates from the booked level, Sprachschule Aktiv Mannheim reserves the right to move the student to a more suitable level in a different course. The assessment of the level takes place by using a certified placement test. The student has no claims from Sprachschule Aktiv doing so, especially a right to cancel the course is debarred.
Cancellation – Deadline – Requirements
According to German law, the customer has the right to cancel a contract concluded online for 14 days after completing the booking. This cancellation has to be declared to Sprachschule Aktiv Mannheim via Mail or postal mail. Each and every customer receives the cancellation instructions.
This right to cancel exists only until the start of course. In case the start of course is within the 14 days of cancellation period, a cancellation still is no longer possible. The right to cancel only exists for online bookings. For all enrolments made in a written way in our school, the customer does not have the right to cancel the contract.
Booking language courses at Sprachschule Aktiv is only possible for a defined period of time, for private courses for a determined number of lessons. In case the student cannot or does not take part in an appointed day of course, he has no right to a refund, partly refund or an additional day of class.
Every customer has the right, after actually taking part in the first lesson, to cancel the booking, in case the booked level cannot be provided by Sprachschule Aktiv in the respective month. In that case the first lesson is a free trial lesson, in case the student decides to continue the trial lesson is a part of the course and not free. The cancellation has to be declared within 24 hours after the trial lesson. After postponing the course (the course did not start at the originally booked starting date) a free trial lesson is no longer possible.
Sprachschule Aktiv Mannheim reserves the right to postpone a course in case the minimum turnout of three students is not reached until it is reached. The absence of a student is not a deregistration or cancellation and does not release the student from the legal obligation to pay for the booked course.
In case a student ends the booked language course prematurely, the whole outstanding course fee is due at once. In case there is a payment plan and the customer does not pay a due installment, the payment plan loses its validity and the whole outstanding course fee is due at once. In case the classes or the course cannot be carried out due to an act of God, the customer does not have the right to a refund or making up for the lessons, that did not take place due to that event.
In case Sprachschule Aktiv Mannheim has to close down temporarely or permanently due to reasons beyond our control, e.g. due to pandemics or epidemics, the customer does not have the right to cancel the contract or is entitled to a refund. During the school is closed the contract is at rest and will be continued unchanged after the reason of the lockdown has ended.
Special terms for visa courses
The customer is, when enrolling, obliged to notify Sprachschule Aktiv Mannheim, that he would like to book a visa course. Visa course is every course, that the customer applies for a visa at the authorities with the respective confirmation.
When booking a language course, that targets on applying for a visa the following terms apply:
The customer is entitled to a refund (minus 250.00 € service fee), if he
1. has informed Sprachschule Aktiv Mannheim in a written way, that he cannot join the course starting at the booked date before the planned start
and
2. has forwarded the notice of rejection within two weeks after the planned start of course.
The customer is not entitled to a refund, if he
1. has not informed Sprachschule Aktiv in a written way before the planned start of course, that he cannot join
or
2. has not forwarded the notice of rejection within two weeks after the planned start of course.
or
3. has postponed the course to a later starting date than originally planned
In case the visa is denied by the authorities, the deposit will be refunded, minus 250.00 € service fee, in case the notice of rejection is forwarded latest two weeks after the planned start of course. This refund will only be carried out, if the school has been informed before the scheduled start of course. In case the visa course cannot be started upon the planned and booked date, the school has to be informed in a written way.
Whenever a course is postponed, a refund is excluded.
In case this notification remains undone, the deposit will not be refunded, even if the notice of rejection will be forwarded later on. The customer is entitled to postpone the course for free for up to four months after the planned start of course. The postponement has to be announced in a written way before the planned start of course.
Intensive courses mostly take place from 9 to 12 in the morning. In rare cases the hours will be adjusted due to organizational reasons. The latest starting time will be 1 pm. The customer does not have the right to cancel the contract or claim a refund or partly refund due to this adjustment.
Telc exam enrolment
Enrolling for an exam is a binding contract. A cancellation is generally not possible. The examination fees are due within five days after enrolling. Additionally to the examination fees, an enrollment fee in the amount of 15.00 € will be imposed. In case the customer cannot take part in the exam due to a sickness, a medical certificate for the cancellation is required. In that case a cancellation fee in the amount of 80.00 € is due.
Special terms for private and corporate training
For private and corporate courses the meeting hours can be arranged individually with the teacher or the administration of Sprachschule Aktiv. In case the student does not attend a lesson, he has no right to a replacement, refund or partly refund. Cancelling the course for companies is generally not possible. In case the participant of the company is not willing to continue the course a cancellation is not possible.
In case the student is not able to join a lesson, that has already been set up with time and date, the teacher has to be informed via phone call or e-mail latest 24 hours before the scheduled start of class. In case this 24-hour-deadline is violated, the lessons will be counted as if the student took them and the student has no right to an additional lesson.
The minimum number of lessons for each meeting is two. (Two times 45 minutes)
One allotment of lesson has to be completed within one year after booking. Lesson, that have not been used within a year expire. A refund, partly refund or cancellation because of this expiration is excluded.
Special terms for low number of participants
In case the number of students is lower than four, Sprachschule Aktiv Mannheim reserves the right to cancel or postpone the respective course. Intensive courses can be shortened to three teaching units (lessons) per day, in case the number of students is lower than four.
In case of cancelling the private course after the free trial lesson, 10 % of the course fee are due as cancellation fee, in case it is less, at least two units have to be paid.
This only goes for private courses.
Disclaimer
Different terms and conditions of the customer will be rejected. In the event of negligently caused property damage and financial damage, we and our vicarious agents are only liable for the breach of an essential contractual obligation, but the amount is limited to the damage that is foreseeable and typical for the contract at the time the contract was concluded.
Severability clause
If a provision of this agreement is legally void, the legal validity of the other provision is not affected.
